Legal History of Cannabis
in the United States

Broadly speaking, across the USA, cannabis is referred to as "marijuana." For the sake of convention, we therefore use the word "marijuana" in this article when referring to any part of the cannabis plant that is used by individuals.





I hardly know where to begin, but I will try. This Act became law on October 2, 1937. Without a doubt, the American people have been continously lied to by successful federal governments, concerning marijuana. The Marijuana Tax Act of 1937 has seen many millions of Americans prosecuted, imprisoned, fined and property forfeited under this and successive Acts of Congress. A great deal has been written on this subject because it is of great concern to a great many people in America. Full text of Act here.

Cannabis and Schedule 1

Cannabis is listed as a Schedule 1 drug in the Controlled Substances Act. There is currently a campaign to have cannabis removed from this Act altogether - H.R. 2306: "Ending Federal Marijuana Prohibition Act of 2011" (full text at govtrack) and to allow the States the freedom to regulate cannabis within State laws. This Bill is currently held up by Rep. Lamar Smith (R-Texas), who has said that his House Judiciary panel will not consider this Bill.  See Removal of cannabis from Schedule I of the Controlled Substances Act.
